These Terms govern your use of cutsmart, provided by Gillian Scharf (Vienna, Austria). By using cutsmart, you agree to these Terms.
App Store note: For the Mac App Store version, Apple's Standard End User License Agreement also applies; these Terms supplement it.
The service
cutsmart is an AI assistant that assembles your own video footage into a Final Cut Pro timeline. cutsmart does not generate footage, scripts, or voices, it only arranges and trims the material you provide. You keep full creative control of, and ownership of, your footage and the resulting edit.
Subscription, billing, cancellation
cutsmart is offered as an auto-renewing subscription.
App Store version: billing is handled by Apple. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your Apple Account settings. A free trial, if offered, converts to a paid subscription unless cancelled before it ends.
Direct version: billing is handled by our payment provider (Polar); cancel from your billing portal. Refunds for App Store purchases are handled by Apple under its policies.
Acceptable use
You agree to use cutsmart only with footage you own or have the right to edit, and not for unlawful content. You may not reverse-engineer, resell, or redistribute the app, or attempt to circumvent subscription validation or usage limits.
Your content
You retain all rights to your footage and edits. You grant us only the limited, temporary processing needed to provide the service (see the Privacy Policy). We claim no ownership of your content and do not use it to train AI models.
Disclaimer & liability
cutsmart is provided „as is." We do not warrant that the AI's editing decisions will be error-free or fit for a particular purpose, always review the result before publishing. To the maximum extent permitted by law, our total liability is limited to the amount you paid for the service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law (including mandatory consumer rights).
Changes & termination
We may update the service or these Terms; material changes will be posted here. We may suspend access for breach of these Terms or for non-payment.
Governing law
These Terms are governed by the laws of Austria, without prejudice to mandatory consumer-protection rules in your country of residence.
